Assessing court action

Delay alone does not make proceedings urgent or guarantee that the court will order a permit to be issued.

How we can help

  1. 01Assess the lawfulness of the decision, the absence of a response and deadlines for taking action.
  2. 02Identify the appropriate route: an administrative action, interim relief or, exceptionally, an urgent order protecting rights, freedoms and guarantees.
  3. 03Organise evidence of applications submitted and the specific effects of the decision or failure to act.
  4. 04Represent the client and follow the court proceedings within the agreed mandate.

Our assistance does not guarantee approval. The decision always rests with the courts and the competent authorities.

Frequently asked questions

Can I seek an urgent order just because I have waited a long time?

Not automatically. Evidence is needed of serious, direct harm to personal rights requiring timely protection and of interim relief being insufficient.

Will the court grant me a residence permit straight away?

This cannot be promised: the decision depends on the claim, legal requirements and proven facts. An order requiring AIMA to decide does not necessarily mean approval.

Do I need to have made an application to AIMA?

Before choosing an action, it is essential to assess the origin and stage of the procedure, the available records and the administration's conduct.
